Case Summary

Isaiah was prohibited from handing out a candy cane with a written legend that gave the story of the Christian meaning behind the candy cane. Although the story is probably just a legend, it still provides a Christian message. Isaiah was prohibited from handing out the messages to his classmates during a class Christmas party. At the direction of the District and Principal, the teacher threw away the messages and allowed Isaiah to only hand out the candy cane. We filed a complaint with the School District and School Board, and eventually appealed to the State Department of Education. The School Board affirmed the actions prohibiting distribution even though other children are allowed to hand out gifts with secular messages, secular gift wrappings, and other viewpoints concerning Christmas. We will be filing a lawsuit.
