U.S. Supreme Court Rules in Favor of FCC's Family Friendly Regulations

On Tuesday April 28, 2009, the U.S. Supreme Court ruled in a 5-4 decision to uphold the Federal Communication Commission’s (“FCC”) censure of indecent language on television. The decision overturned a ruling by the U.S. Court of Appeals for the Second Circuit which previously held that Fox Broadcasting Company (“Fox”) should not be held liable for breaking the FCC’s rules prohibiting the use of indecent language on broadcast television during times when children might be watching.

House Bill 1319, also known as the Local Law Enforcement and Hate Crimes Prevention Act of 2009, was recently reintroduced to the United State’s House of Representatives by Representative John Conyers (D-MI) and Representative Mark Kirk (R-IL).  This Bill was originally introduced as the Matthew Sheppard Act in 2007 in response to the murder of a homosexual male in an anti-gay hate crime that occurred in Wyoming.

Battle for Traditional Marriage Rages in Vermont and Iowa

Vermont’s House of Representatives voted last week to legalize same-sex marriage, but fell four votes shy of the veto-overriding majority needed to oppose Governor, Jim Douglas’ promised veto.  On Tuesday April 7, 2009, the Vermont legislature voted again and this time voted 100-49 to legalize gay marriage.  The Senate followed shortly thereafter with a vote of 23-5, thus overriding the Governor’s veto and legalizing same-sex marriage in the state that was the first to establish civil unions.

On Wednesday, April 1, 2009, Advocates attorneys filed a brief in California Education Committee v. Jack O’Connell, a case challenging the constitutionality of Senate Bill 777.  This statute redefines the term “gender” in the California Education Code for all public schools.  Recently, the Attorney General’s office filed a brief on behalf of the Superintendent of Public Instruction, Jack O’Connell, to dismiss the case.  Advocates attorneys are now vigorously opposing the Defendants’ argument and asking the Court to deny the Defendant’s attempt to dismiss the case. 

New Order Allows for Destruction of Human Embryos

On March 9, 2009, President Obama issued an executive order for the removal of “barriers to responsible scientific research involving human stem cells.”  This order allows for human embryos to be used in stem cell research.

On Wednesday, March 18, 2009, President Obama publically endorsed the United Nation’s Statement promoting the international decriminalization of homosexuality.  Questions remain regarding the effect the President’s actions will have on constitutionally guaranteed religious liberty rights.

The Fight for the Cross Continues

The Mt. Soledad Cross is under scrutiny again!  In a case that began over twenty years ago, the fate of the Mt. Soledad Cross seemingly was resolved in August of 2008, when the U.S. District Court issued a favorable decision for the Cross wherein Judge Larry Alan Burns held that the Cross stands as a symbol of the sacrifice veterans made, and continue to make, fighting for this Nation and therefore the Cross could continue to stand on public land as a National Veterans Memorial.

Advocates for Faith and Freedom filed a petition with the United States Supreme Court asking the Justices to protect our clients' right to form a Bible club at Kentridge High School in Kent, Washington.  The Bible club is named "Truth."

Marriage Appears Victorious in California Supreme Court

March 5, 2009, was an encouraging day for traditional marriage in the California Supreme Court!  Advocates attorneys were present in the courtroom when the California Supreme Court heard oral arguments from both sides in a challenge brought by the ACLU, the City of San Francisco, and others to Article 1, Section 7.5 of the California Constitution, also known as Proposition 8.  Article 1, Section 7.5 of the California Constitution defines marriage as being between one man and one woman.
