Benitez v. North Coast Women’s Care Center

Standing up for a Christian's right to extend his or her moral religious convictions into the workplace

How would you react if the state's highest court ruled that you as a Christian must ignore your religious beliefs as they apply to your chosen profession? This case is being closely watched across the country as Advocates' attorneys defend two Christian physicians who specialize in fertility treatment. Because of their moral and religious convictions against inseminating any unmarried woman, a lesbian woman filed a lawsuit against Dr. Christine Brody and Dr. Douglas Fenton and the medical center, alleging they discriminated against her because of her "sexual orientation."

This case has been ongoing for years, and recently reached the California Supreme Court. In August, 2008, in a 7-0 decision, the California Supreme Court asserted that a Christian physician does not have a constitutional right to refuse to perform an elective medical procedure on religious grounds.

The California Supreme Court recently refused to reconsider the case after Advocates' attorneys and allied counsel filed a petition asking the California Supreme Court to rehear the case in light of the significant negative impact the ruling will have on religious liberty rights in California. At the present time, we are evaluating our continuing legal strategy which could include a potential appeal to the United States Supreme Court.

In the midst of this continuing battle, Dr. Brody and her family have not lost hope but remain steadfast in their faith knowing that the outcome of this case is a chance to glorify God. Dr. Brody stated, "All I want to do is be able to practice medicine without violating the religious beliefs that define me."

If you believe Dr. Brody and Dr. Fenton should be able to exercise their faith in the workplace, partner with us today. This has been a long, hard-fought, six year battle. Our right to exercise our religious beliefs includes far more than the right to believe; it includes the right to conform our actions to those beliefs.

"So we may boldly say: The LORD is my helper;
I will not fear. What can man do to me
?"

Hebrews 13:6
