Will Marriage Have Meaning After March 4?
March 4, 2008 will mark a historic day in California.
Despite the fact that close to two-thirds of California’s
voters enacted Proposition 22, which states that marriage can only be between a man and a woman, same-sex marriage advocates argued in the California Supreme Court that they should be allowed to marry persons of the same sex.
The problem, Proposition 22 only amended the California Family Law Code and not the California Constitution. Therefore, radical same-sex marriage advocates are arguing that Proposition 22 violates the California Constitution’s equal protection provisions.
This was the argument that San Francisco Mayor Gavin Newsom used when he began issuing same-sex marriage licenses on Valentine’s weekend in 2004.
Advocates General Counsel, Robert Tyler, was the first lawyer in 2004 to go to San Francisco in order to commence litigation and argue in court that the Mayor’s illegal actions needed to be stopped. For weeks, neither the Governor nor State Attorney General did anything to help. After numerous weeks of intense litigation, the California Supreme Court ordered the Mayor to cease and desist his illegal actions. A few months later, the California Supreme Court declared the same-sex marriage licenses were illegal and void under California’s then-existing law. However, that ruling did not prevent the radicals from pursuing a separate lawsuit in an attempt to overturn Proposition 22 in the courts.
The ACLU, the City Attorney for San Francisco, and other radical well-funded organizations have pursued their case all the way back to the California Supreme Court by arguing that the people’s initiative, Proposition 22, is unconstitutional. Advocates for Faith and Freedom is a committed member of the California Statewide Committee promoting a constitutional amendment on the November Presidential ballot which will allow the voters of California to decide – once and for all – that marriage in our state be preserved for a man and a woman.
Why is this necessary? Didn’t we pass Prop 22 years ago? The answer is YES.In 2000, California voters passed Prop 22 - the voter instituted definition of marriage as only between a man and a woman. As you have seen on the front page of our newsletter, the California State Supreme Court will now decide if Prop 22 is a violation of the equal protection provisions of the California Constitution. The only way to be sure to preserve marriage between a man and a woman is for the people of California to adopt a constitutional amendment that cannot be overturned by the California Supreme Court!
